If you both play on the same device, yes. You would have the same IP, which means he could get banned for a bypass. You can try to appeal and explain it, but i doubt it will be accepted, as it is commonly used as a lie to get unbanned too. But as you say youre legit anyways, just waig for your unban and you both will be able to play again. Good luck with your appeal too!

Doesn't Cubecraft just block the ip address for the duration of his ban without giving ban to his brother? I'm referring to this article by Cubecraft.
That would be true, the network would indeed be connection blocked but if despite that they somehow manage to bypass the punishment, they would still be banned
