To prevent ambiguity, "Discord" will refer to Discord's platform as a whole and "discord server" will refer to Cube's official discord server.

Suggestion

It's seems like Discord's rules were overlooked. Because CubeCraft uses Discord as a service, Discord rules also apply. Add Discord's rules as a reminder to the CubeCraft discord rules section. All it needs is one additional line saying something like"by using our discord server, in addition to following our discord rules, you also must follow Discord's ToS and guidelines."

Explanation

Though section 4 of the rules posted on Cube's website and discord server say that advertising is not allowed, it's implicitly said that advertising Cube-related discord servers is allowed. According to this post, while that OP did not break any CubeCraft rules, he did break Discord's rules under its Terms of Service (ToS):

An example of unsolicited marketing is seen in the post above by privately messaging someone a server invitation on Discord without the recipient's consent. Consent must be given by writing or verbally from the recipient for it to not count as unsolicited advertising within Discord. This is a loophole within the rules especially when both the sender and recipient share CubeCraft as a mutual discord server.

Under Discord's ToS and because it took place inside Discord, the OP could have had his account banned from Discord's service, something that the current rules seem to not address clearly. The way the case above was handled regarding Cube's rules was correct, but with Discord's rules taken into account it wasn't properly handled. People are still at risk of getting banned from Discord. It would, however, certainly be allowed to promote a Cube-related discord server on Cube's forums as shown in this post.

Since you are trying to be extremely specific and going through ToS and our statements I am also going to do this in great detail.

The exact sentence written in the Discord ToS is as follows:

-your use of the service you will not include sending unsolicited marketing messages or broadcasts (i.e., spam).

First of all, this message strings the words unsolicited and marketing together, marketing is a term used for advertising in a commercial nature, which advertising a CubeCraft based Discord server is not, they are a community server, their goal is not to make money or advertise their products, so straight away they do not match this statement in the ToS.

Furthermore the sentence even states "spam" is brackets, they are directly referring to content that gets sent to many people at once in a copy/paste fashion.


Which is also why Animal stated this clearly:

So in conclusion, the content is not for any commercial purpose therefore it doesn't break the ToS nor is it even being spammed at all.

As for the suggestion itself, players should be reading the Discord ToS before even using the service, it's not technically our job to enforce users to abide by Discord's ToS, I think it'll clutter our rules page when we dont need it to.

All it needs to say is "in addition to following our rules, you must also abide by Discord's ToS and guidelines." One line only shouldn't add clutter.

There are many countless examples of advertising community discord servers. Even though they're not making money (it's not marketing; you're right on that), it's broadcasting and it's still unsolicited because lack of consent. Here's some examples below.

Example 1: the typical case.

Example 2: A friend merely sending an invitation without the recipient's consent. For protection, his name will remain anonymous.

The two may be different in that the former was (most likely) spammed by a bot while the latter was done by a human, but the goal is the same: broadcast as many of these invitations as possible to bring people in to grow their servers. The key both share is that there's no consent. If there's no consent, it's unsolicited, whether it's to promote something like that for money or not. Just one instance of it is enough for Discord to take action if it's reported, even if the invitation is sent to only one person.

Didn't you link a community Discord in your post and that's what you are upset about? you used that as a main pointer in your thread, so I'm not entirely sure why you're referencing spambots which I did say should get banned as we already do.
