Rules are rules. I don't see why cube should change them for you? You're probably not the first youtuber with the same amount of video's on cube. If they break the rule, they'll probably have to do the same with everyone who has the same stats as you.

Unfortunately there is a rule about how many subs you need to receive a YouTube rank.
Just keep going with what you're doing and hopefully you will reach the 40k :)
