How is this player NOT hacking?

A little while back, I reported this player that is clearly hacking. He made some comments on my video saying how he was going to appeal, calling me a noob, admitting to using alt accounts and the likes. The thing is, it is he is OBVIOUSLY hacking yet his appeal was accepted.

Do you think he should have been unbanned?

The moderator in charge accepted the players appeal. If he hacks again he won't be given another chance.
