Ok, so my idea is that when you donate, you get access to the level 1,2,3,etc kits for free, but will be able to be bought with points if youre a non donator.

This I don't think will affect gameplay since non-donators do have access to the kits by getting points for it, just donators get it for free by donating.

As mojang states, You are allowed to sell in-game items so long as they don’t affect gameplay
We don’t mind you selling items in game, but they must be purely cosmetic. Pets, hats, and particle effects are OK, but swords, invincibility potions, and man-eating pigs are not. We want all players to be presented with the same gameplay features, whether they decide to pay or not

The players will still have the same gameplay features just need to get points for it unlike donators.

Sorry if this idea was already out, I didn't see any when I looked.

    Erm I just realized that I was focusing on kitpvp but I think this would also work on games server(for op-er kits), creative(for plots), etc. c;

I like this idea, and I don't think it goes against the EULA, either. As long as the kits don't cost a million points, and it's possible for everyone to get it, I think it's fine. @Gjpoppy After all, the gameplay features are available to everyone.

But not so much as to be impossible, ridiculous, or frustrating.

I'm pretty sure this is not EULA-compliant.

"boosters, item generators, and all other features that affect gameplay are not allowed."
"Can I sell “kits” for hard currency if I provide a balanced alternative for non-paying users?
If the “kits” contain gameplay-affecting features they are not allowed. Gameplay balance is not relevant to the EULA. If the items included in the kit are purely cosmetic, you can charge real money/hard currency"
    (Source: https://mojang.com/2014/06/lets-talk-server-monetisation-the-follow-up-qa/)

Sounds like a neat idea, but looks like it's not legal. Sorry guys.

and just to be clear on this, it doesn't matter if the kits are overpowered, underpowered, or balanced. The simple fact that there are gameplay-affecting kits being sold for hard currency makes this violate the EULA.

The kits are available to everyone, so the kits are not gameplay affecting because everyone can have it.

I believe you're referring to this passage:
"How should servers deal with users who have already spent hard currency on features that affect gameplay?
Users may keep the perks they’ve paid for on the condition that the same perks are available to other players on the server (directly or purchasable using soft currency). It’s up to the server host to decide how to compensate users for previous transactions."

Yeah, EULA still applies to them. Unless the owners are planning to sift through each and every donation to make sure they donated before August 1st and make special "before EULA" ranks, I don't think this is gonna fly. You need to keep in mind that people are indeed still donating, and that it is now illegal to offer gameplay-altering perks through hard currency donations. Maybe they're planning to make some sort of "veteran" rank, but I doubt it. The EULA madness, as Halo calls it, has died down. I'm happy with how things currently are running, with the new perks they're giving us donors, and with the future plans for renovating a post-EULA Cubecraft.

While this is true, donors (according to this plan) get something for free that would otherwise cost points, essentially giving donors free points. You cannot donate hard currency in exchange for soft currency, nor can you donate for a game-altering perk (even if you stuck a wooden sword spawner in the middle of kitpvp and game donors a /woodsword command, THIS WOULD BE ILLEGAL.)

If donators get access to the kit without paying in points then it is against the EULA however, if the kit was unlocked, but you still had to buy it with points

No, I mean if you donate you unlock permission to buy the kit with points not if you donate you get the kit
